ANYTHING FOR BABY , INC. , BEING NEITHER THE MANUFACTURER, NOR A SUPPLIER, NOR A DEALER IN EQUIPMENT, MAKES NO WARRANTY, EXPRESS OR IMPLIED, TO ANYONE, AS TO THE FITNESS, MERCHANTABILITY, DESIGN, CONDITION, CAPACITY, PERFORMANCE OR ANY OTHER ASPECT OF THE EQUIPMENT OR ITS MATERIAL OR WORKMANSHIP. Anything for Baby, Inc., further disclaims any liability for loss, damage or injury to Customer or third parties as a result of any defects in the equipment or the Customer’s or third parties’ installation, use or Maintenance of the equipment. Anything for Baby, Inc. shall have no obligation to install, erect, test, adjust or service the equipment. As to Anything for Baby, Inc., the Customer leases the equipment “as is.” The Customer further agrees to indemnify and hold harmless Anything for Baby, Inc., its officers, directors, employees and agents against any and all losses, claims, damages, liabilities or expenses, including reasonable attorneys fees, arising, directly or indirectly, out of the rental of the equipment or that is in any way connected to the equipment .
